Injuries caused by negligence, recklessness, or intentional actions can create chaos in the victim’s life. They require expensive medical treatment and often force victims to miss work. They can cause pain, psychological damage, and long-term disablity.

The law firm of Nessler & Associates serves a wide range of injury victims. We have represented victims of negligence, misconduct, and corporate greed since 1977. We have more than 100 years of combined experience in seven legal practice areas.

Our law practice deals with civil law, which differs from criminal law in several respects. The government prosecutes criminal cases when a person has been accused of violating a statute in the criminal code. Civil law allows a person to sue another person, company, or government entity for causing some type of injury or violating their rights.

The legal team at Nessler & Associates can help you recover financially from personal injury, product liability, medical malpractice, property loss, vehicle accidents, workplace issues, and other causes of damage.

Personal Injury

Nessler & Associates has recovered millions of dollars for personal injury victims. You can file a personal injury claim based on negligence, strict liability, or intentionally causing harm. Negligence requires the liable party to violate a duty of care. Strict liability makes a party accountable regardless of knowledge or intent.

Common law affects the details of personal injury cases. It uses previous court decisions to handle situations that written laws do not cover. Some causes of action for personal injury cases include:

  • Assault and battery
  • Dog bite
  • Drunk driving injuries
  • Head injuries
  • Institutional sexual abuse
  • Pedestrian accident
  • Slip-and-fall accidents

When someone commits assault and battery, that person intends to do harm. Pedestrian accidents usually arise out of a driver’s negligence. Defective products that cause injury or illness are also covered by strict liability; however, these claims require specialized knowledge.

Product Liability

Dangerous or defective products can cause severe injuries. Strict liability means the product maker does not need to know about the defect to be held responsible. Some cases might qualify for punitive damages if we discover that the company knew about the danger but did not warn consumers.

Victims of defective products can file an individual claim or join a class action lawsuit. If enough people file claims, the court might combine them into a multi-district litigation (MDL). This process transfers all similar individual and class action claims to one court. Combining the discovery process and pre-trial motions saves both sides money and time.

The parties involved choose a few cases to use as bellwethers. These cases show attorneys how juries might rule on future issues, allowing them to reach fair settlements. There are currently product liability cases in progress for:

  • 3M earplugs
  • Defective hernia mesh
  • Mesothelioma and asbestos
  • Philips CPAP machines with toxic components
  • Roundup exposure
  • Talcum/baby powder
  • Zantac

Some cases, such as defective hernia mesh claims, can also have a medical malpractice component. If the surgeon does not place the mesh properly, it can cause some defective meshes to fail.

Medical Malpractice

People trust their medical professionals. Being a victim of negligent medical care can damage more than your trust in your doctor. It can harm your health. Government agencies write health law and regulations but do not prevent all causes of negligence.

Successful claims must show that a health care provider violated the commonly accepted standard of care. We can also hold the facility liable if systemic errors contributed to the negligence.

We work with medical experts who can find evidence of negligent behavior in your records and through interviews with staff and witnesses. They can also spot issues in the facility that led to your injury. Common causes of action for malpractice claims include:

  • Birth injury
  • Catastrophic injury
  • Cerebral palsy
  • Dental malpractice
  • ER malpractice
  • Erb’s palsy
  • Hospital negligence during labor and delivery
  • Pharmacy negligence
  • Spinal cord injury
  • Wrongful death

Health care professionals carry medical malpractice insurance. We settle most claims by negotiating with the insurance companies. We have substantial experience negotiating with many types of insurers, including property insurance companies.

Property Loss and Damage Claims

Property damage can destroy your home or business, causing significant financial distress. Property insurance helps you recover more quickly and thoroughly. Some insurance companies wrongfully deny claims or use dirty tactics to minimize the payout.

Insurers might claim that you lied about how the damage occurred. They can also argue that they do not cover the cause of the damage you suffered. Some might delay the settlement process to pressure you into accepting a smaller amount. We handle the following types of insurance claims.

  • Art insurance
  • Commercial property insurance
  • Property damage
  • Residential property insurance
  • Storm and hail damage
  • Water damage claims

We can help you gather the evidence you need to win these claims. If it becomes necessary, we can investigate the cause of the damge. Other cases that we investigate include vehicle accidents.

Vehicle Accidents

More than 2.25 million people suffered injuries in traffic accidents in 2020 across the US. Many of these victims suffer long-term or permanent physical or mental injuries. One study links whiplash, spinal cord injury, and mild to moderate traumatic brain injury to long-lasting psychological harm.

We understand how motorcycle, truck, and bus accidents differ from auto accidents involving passenger vehicles. We will fight for maximum compensation from the insurance company. We handle many types of vehicle accidents, including:

  • Auto accident
  • Boat accident and recreational accident
  • Bus accident
  • Motorcycle accident

  • Uninsured drivers

Vehicle accidents can cause catastrophic injuries that lead to death or permanent disability. Disabilities can also be caused by workplace accidents.
