The first thing that I tell a potential client that has not applied for Social Security Disability or Supplemental Security Income is, “If you feel that you meet the qualifications for benefits, apply!”  In order to apply, you can either (1) apply online at or (2) schedule a phone appointment with your local Social Security office and apply over the phone.

The unfortunate truth of the matter is most individuals are denied Social Security Disability and/or Supplemental Security Income after their initial application. This typically happens regardless of whether you have an attorney.  After your first denial, you should consider hiring an attorney to help you protect your rights. Generally, you have 60 days from your date of denial to request the Social Security Administration reconsider its decision.  Don’t wait until the last minute.  That said, you may decide you are comfortable proceeding forward on your own, and that’s alright. However, it is crucial that you appropriately and timely file your request for reconsideration within the 60-day time period. 

If, after you file a request for reconsideration, you are still denied benefits, it is time to seek a Social Security Disability attorney.  Do not delay.  You have 60 days to file a Request for an Administrative Law Judge Hearing. This hearing is your best opportunity to obtain a favorable decision. This hearing will be conducted in front of an Administrative Law Judge, and certain complex procedural rules apply.  An experienced Social Security Disability lawyer will help you navigate the complexities of this hearing.

Please understand, that even with the help of a Social Security attorney, the hearing process takes time.  After your request, it may take months for your hearing to be scheduled, because the system is horribly backlogged.  An attorney will utilize this time to prepare your case for hearing.  Do not wait until your hearing is scheduled to hire a Social Security attorney.  The necessity of this preparation period is why it is so important that, if you have been denied benefits after your request for reconsideration, you seek an attorney right away.  Time is needed to appropriately prepare for your hearing.  While a Social Security attorney cannot guarantee that you will be awarded Social Security Disability or Supplemental Security Income benefits, a Social Security attorney can make certain that your case is properly prepared prior to your hearing, and that will give you the best chance at being awarded benefits.
